    Nigeria BF-APEA Legal and Policy Analysis Consultancy

    Background

    Moving Integrated, Quality Maternal, Newborn, Child Health and Family Planning and Reproductive Health (MNCH/FP/RH) Services to Scale (MOMENTUM) Country and Global Leadership is a five-year global project funded by the U.S. Agency for International Development (USAID) and led by Jhpiego to provide targeted MNCH/FP/RH technical and capacity development assistance to countries to facilitate their journeys to self-reliance. MOMENTUM aims to contribute to global technical leadership and learning, and USAID’s policy dialogue for achievement of global MNCH/FP/RH goals through support to globally endorsed MNCH/FP/RH initiatives, strategies, frameworks, guidelines, and action plans.Under the global MOMENTUM program, Pact is collaborating with The Manoff Group (TMG) to support an activity aimed at preventing and mitigating the consequences of violence against women and girls and addressing possible drivers of child early and forced marriage. To achieve its purpose, the Activity is grounded in a socioecological model framework of behavioral change that understands that there are a range of complex drivers and factors that perpetuate sexual violence (SV), intimate partner violence (IPV), and child and early forced marriage (CEFM), as well as early adolescent pregnancy.

    As part of a comprehensive package of interventions, the MOMENTUM Nigeria Activity will include a Behaviorally-Focused Applied Political Economy Analysis (BF-APEA). BFAPEA is an approach aimed at helping projects and country partners to understand the underlying incentives, interests, and systemic behaviors that explain the persistence of stubborn, “sticky problems” within complex governance systems. The methodology is aimed at looking beyond “technical,” capacity, and resource-related constraints. Instead, it is directed at making the formal and informal drivers that shape the actions and decisions of key actors transparent and visible. The MOMENTUM Nigeria BF-APEA will contribute to the following intermediate results (IRs):

    IR1.1: Increased effectiveness of country institutions and systems to sustainably plan and manage quality IPV, SV, early adolescent pregnancy, CEFM prevention interventions.

    IR 4.1: Multi-sectoral partnerships and coordination to respond to and prevent IPV, SV and CEFM

    Specifically, the MOMENTUM Nigeria BF-APEA will uncover the complicated factors that limit and enable local leaders to positively influence positive norms and implement laws and policies related to IPV, SV, and CEFM. It will also map specific behaviors that, if practiced, will allow local leaders to play a more constructive role in addressing these harmful social practices.

    Consultancy Objectives

    The consultant will conduct an analysis of the overarching legal and policy framework related to IPV, SV, and CEFM. This analysis will:

    Provide a de jure mapping of key laws and policies related to IPV, SV, and CEFM. This will include reviewing key laws and policies at the national level, as well as state-level formulation in Ebonyi and Sokoto states.

    Review and document issues related to the de facto implementation of keys laws related to IPV, SV, and CEFM at the national and state level

    Reporting

    The consultant will report to Pact’s Senior Capacity Development Specialist on the MOMENTUM Nigeria project team. Additional support and guidance will come from Pact’s Global Governance team

    Duties and Responsibilities

    • To develop an accurate and detailed map of the legal and policy framework as it relates to IPV, SV, and CEFM at the national and state level, the consultant will carry out a combination of secondary analysis (including review of key laws/policies and existing literature) and primary analysis with expert individuals and institutions. Key duties and responsibilities will include the following:
    • Participate in an inception meeting with the project team to determine the final scope. The consultant should use that meeting to inform the development of a final assessment methodology.
    • Review and summarize key national laws and policies (including relevant government strategies) related to IPV, SV, and CEFM. This should include documenting the purpose/objectives, status, focus, responsible agencies, key stakeholders, target beneficiaries, etc. of relevant laws and policies. To ensure all relevant laws/policies are captured, the consultant is expected to review existing available analyses of the legal/policy framework and consult with leading experts and organizations on the status and significance of key statutes.
    • Review and summarize relevant laws and policies in Ebonyi and Sokoto states related to IPV, SV, and CEFM. This should include reviewing the status of state level formulation of national legal mandates.
    • Based on consultation with key experts at the national and state levels, review the status of implementation of key laws and policies related to IPV, SV, and CEFM. Summarize the key factors that hinder and enable the full implementation of priority laws and policies. This should include outlining the role played by key government and non-government agencies in ensuring the implementation of the legal and policy framework. Particular attention should be paid to categorizing existing gaps in implementation.
    • As possible, document the role envisioned (and role actually played) by local leaders in implementing key laws/policies related to IPV, SV, and CEFM, including, but not limited to, LGA officers, traditional authorities, religious authorities, etc.
    • Document findings from #1-4 in a comprehensive final “Legal and Policy Analysis.” This should include a succinct 15-20 page report with an annex summarizing individual laws and policies.

    Deliverables

    • Final research methodology. This should include a summary of the types of secondary and primary sources to be consulted.
    • Summary outline of key national laws/policies relevant to IPV, SV, and CEFM.
    • Summary of key of key state-level laws/policies and implementation challenges relevant to IPV, SV, and CEFM.
    • Final report, annexes, and accompanying PowerPoint slide deck for donor and partner presentations.

    Estimated Level of Effort

    We anticipate the level of effort to be equal to or less than 30 days for this assignment. This is an estimated figure, to be discussed and finalized with the identified candidate.

    Skills and Qualifications

    Expected Qualifications

    • Demonstrated experience conducing legal and policy analysis and/or political analysis on complex topics in Nigeria.
    • Demonstrated experience leading secondary literature reviews and qualitative primary data collection.
    • Strong English writing capabilities.
    • Willingness to consult with and accept feedback from project team members.
    • Current presence in Nigeria.

    Preferred Qualifications

    • Experience related to IPV, SV, CEFM, GBV, or related policy areas.
    • Experience working in Ebonyi and/or Sokoto states, including knowledge of relevant political and legal structures.
