Section I: Instructions to Consultants

1        Introduction

• Only eligible Consultants may submit a Technical Proposal and Financial Proposal for the services required. The proposal shall be the basis for contract negotiations and ultimately for a signed contract with the selected Consultant.
• The Consultants costs of preparing the proposal and of negotiating the contract, including visit/s to the FSSP, are not reimbursable as a direct cost of the assignment.
• Consultants shall not be hired for any assignment that would conflict with their prior or current obligations to other procuring entities, or that may place them in a position of not being able to carry out the assignment in the best interest of FSSP.
• FSSP is not bound to accept any proposal and reserves the right to annul the selection process at any time prior to contract award, without thereby incurring any liability to the Consultant.
• FSSP Policy requires that all FSSP personnel, bidders, manufacturers, suppliers or distributors, observe the highest standard of ethics during the procurement and execution of all contracts. FSSP shall reject any proposal put forward by bidders, or where applicable, terminate their contract, if it is determined that they have engaged in corrupt, fraudulent, collusive or coercive practices. In pursuance of this policy, FSSP defines for purposes of this paragraph the terms set forth below as follows:

• Corrupt practice means the offering, giving, receiving or soliciting, directly or indirectly, of anything of value to influence the action of the Procuring/Contracting Entity in the procurement process or in contract execution;
• Fraudulent practice is any act or omission, including a misrepresentation, that knowingly or recklessly misleads, or attempts to mislead, the Procuring/Contracting Entity in the procurement process or the execution of a contract, to obtain a financial gain or other benefit to avoid an obligation;
• Collusive practice is an undisclosed arrangement between two or more bidders designed to artificially alter the results of the tender procedure to obtain a financial gain or other benefit;
• Coercive practice is impairing or harming, or threatening to impair or harm, directly or indirectly, any participant in the tender process to influence improperly its activities in a procurement process or affect the execution of a contract.

1.6     At any time before the submission of the proposals, FSSP may, for any reason, whether at its own initiative or in response to a clarification amend the RFP. Any amendment made will be made available to all short-listed Consultants.

1.7     Consultants must be ready to provide proof of eligibility to work in Nigeria such as International passport, National Identity Card, Tax Identity Number registration, or valid work permit

1.8     A Consultant’s proposal shall have three (3) components:

• A Cover Letter,
• The consultant’s CV, and
• Financial proposal (the consultant’s daily rate quotation in Naira).

2        Cover Letter

In the Cover letter, the consultant must demonstrate how they meet all the key requirements in the ToR.

3        CV

3.1     When preparing their CV, Consultants must, among others, provide the following information:

• Education and work experience.
• Contact email and telephone.
• Date of earliest availability.

4        Financial Proposal

4.1     The Financial Proposal consists of the Financial Proposal Form, shall be based on an all-inclusive daily rate of the Consultant. The rate shall include, but not limited to all taxes, insurance, telecommunication expenses, own IT facilities (phone and laptop), and transport to and from office. Only expenses incurred during field trips outside Abuja will be reimbursable.

4.2     Consultants shall express the price of their financial proposal in Naira.

4.3     The Financial Proposal shall be valid for 60 calendar days. During this period, the Consultant is expected to be available for the assignment. FSSP will make its best effort to complete negotiations and determine the award within the validity period. If FSSP wishes to extend the validity period of the proposals, the Consultant has the right not to extend the validity of the proposals.
